{"id":1267,"date":"2026-05-06T04:35:02","date_gmt":"2026-05-06T04:35:02","guid":{"rendered":"https:\/\/schminkzimmer.com\/?page_id=1267"},"modified":"2026-08-26T15:53:05","modified_gmt":"2026-08-26T15:53:05","slug":"agb","status":"publish","type":"page","link":"https:\/\/schminkzimmer.com\/en\/agb\/","title":{"rendered":"Allgemeine Gesch\u00e4ftsbedingungen"},"content":{"rendered":"<p class=\"wp-block-paragraph\">\u00a7 1 Scope of Application<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions (hereinafter \u201cGTC\u201d) apply to all contracts for services and the sale of products between Ewa Zuzanna Fa\u00df, owner of SCHMINKZIMMER (hereinafter \u201cStudio\u201d), and the client (hereinafter \u201cClient\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The language of the contract is English. Any terms and conditions of the customer that differ from or conflict with these terms will not be recognized unless the Studio expressly agrees to their validity in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current version of the Terms and Conditions is posted in the studio and available on the studio's website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 2 Scope of Services &amp; Treatments<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The type, scope, and duration of the treatments offered are based on the studio\u2019s current list of services and prices. The price list is available for review at the studio and may be updated at any time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If necessary, the duration of the treatment can be adjusted in consultation with the client. Treatments generally begin and end at the agreed-upon time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio reserves the right to refuse or discontinue individual services for medical, hygienic, or other objective reasons. This applies in particular if the treatment appears to be unsuitable for the client\u2019s health or if the client has provided incomplete or inaccurate information regarding his or her health.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 3 Preliminary Consultation &amp; Health Information<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before each treatment, the client is required to provide complete and truthful information regarding all health-related matters (e.g., allergies, skin conditions, pregnancy, medications, and pre-existing conditions).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio assumes no liability for damages or adverse reactions resulting from incomplete, incorrect, or withheld information provided by the client. In such cases, the client shall indemnify the studio against any claims by third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anamnesis and consent forms must be completed in full and signed before the first treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 4 Scheduling Appointments &amp; Cancellations<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheduled appointments are binding. To cancel or reschedule an appointment, the customer must notify the studio at least 24 hours in advance (by phone, WhatsApp, or email).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cancellation made in a timely manner (more than 24 hours in advance): No charges apply.<\/li>\n\n\n\n<li>Last-minute cancellation (less than 24 hours in advance): The studio may charge a cancellation fee of up to 50% of the agreed-upon treatment price, since the appointment could not be rescheduled.<\/li>\n\n\n\n<li>No-Show: If you fail to show up without prior notice, you may be charged the full treatment fee, minus the cost of any unused materials. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Late Arrival: If the client arrives late, the full booked treatment time will be charged. The treatment will end at the agreed-upon time if there is a follow-up appointment. An extension is not guaranteed.<\/li>\n\n\n\n<li>Advance Payment: In the event of repeated cancellations or no-shows, the studio reserves the right to accept future appointments only upon advance payment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Note: The studio makes every effort to reschedule canceled appointments at short notice. The decision to charge a cancellation fee is at the studio\u2019s discretion and is always evaluated on a case-by-case basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 5 Prices &amp; Payment<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prices listed in the price list as of the date of service provision apply. All prices are final prices (including applicable sales tax, if any).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment is due immediately upon completion of the service and must be made by debit card. Invoicing upon request is possible in an emergency or if the debit card terminal is out of service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio reserves the right to adjust prices. Any changes will be communicated to the customer in a timely manner and will take effect as of the announced date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 6 Gift vouchers<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Validity Period: Gift certificates are valid for 3 years from the date of issuance (in accordance with the statutory limitation period under Sections 195 and 199 of the German Civil Code (BGB)). Upon expiration of the validity period, the gift certificate becomes void and worthless, to the extent permitted by law.<\/li>\n\n\n\n<li>Transferability: Gift vouchers are transferable to third parties, provided they accept the studio's terms and conditions.<\/li>\n\n\n\n<li>Cash redeemability: The voucher value cannot be redeemed for cash.<\/li>\n\n\n\n<li>Partial Redemption: Gift vouchers can be redeemed in part; the remaining balance remains valid until the expiration date.<\/li>\n\n\n\n<li>Loss: The studio is not liable for the loss, theft, or misuse of gift vouchers.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 7 Product Sales, Exchanges, and Returns<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Statutory warranty rights apply to the purchase of products. Exchanges or returns are not permitted in the following cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Products that have already been opened or used (for hygiene reasons).<\/li>\n\n\n\n<li>Goods ordered specifically for the customer.<\/li>\n\n\n\n<li>Sale items that are expressly marked as non-returnable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Unopened products may be exchanged within 14 days of purchase upon presentation of the receipt, provided there are no grounds for exclusion. In cases of proven intolerance (upon presentation of a doctor\u2019s note or proof of allergy), we will consider the matter on a case-by-case basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 8 Warranty &amp; Results Guarantee<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio uses expert techniques and tested products for all facial and body treatments. Since treatment results may vary from person to person, no guarantee is made regarding specific treatment success, specific tolerability, or a specific outcome.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This applies in particular if the client provided incomplete or inaccurate information during the initial consultation or on the medical history form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Complaints regarding the treatment provided must be reported immediately after the treatment so that they can be investigated. Complaints submitted at a later date can only be considered if a credible causal link to the treatment can be established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Customer's Obligation to Provide Follow-Up Care:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The client must follow the aftercare instructions recommended and explained by the studio, as well as any measures that are essential for maintaining the desired treatment results. The studio assumes no liability for any adverse effects on the treatment results resulting from failure to follow these aftercare recommendations. In such cases, the client is not entitled to free follow-up treatment or a refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note: Aftercare recommendations are explained to the customer verbally and provided in writing upon request. It is the customer\u2019s responsibility to follow these recommendations consistently.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-8f761849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Satisfaction Guarantee and Fair Prices:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the extremely rare event of complete dissatisfaction with a treatment, where the customer does not wish to receive any further treatments at the studio, Schminkzimmer will be lenient and charge only for the time spent on the treatment and the cost of materials. This amounts to a flat rate of 25% of the final price of the respective treatment.<\/p>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 9 Liability<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio bears unlimited liability for damages resulting from injury to life, body, or health that are attributable to an intentional or negligent breach of duty by the studio, its legal representatives, or its agents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio is liable for other damages only in cases of willful misconduct or gross negligence. Liability for breaches of non-essential contractual obligations resulting from slight negligence is excluded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio assumes no liability for customers' personal belongings, clothing, or valuables that are damaged or lost during their visit to the studio.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Important: These limitations of liability do not apply to claims under the Product Liability Act or in cases of fraudulent concealment of defects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 10 Studio Rules &amp; Conduct<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio reserves the right to remove from the premises any person who violates the house rules, is under the influence of alcohol or drugs, or harasses staff or other customers. In such cases, there is no entitlement to a refund for services already paid for.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Children under the age of 16 may receive certain treatments only with the written consent of a parent or legal guardian.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 11 Data Protection &amp; Communication<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio collects and processes customers\u2019 personal data solely for the purposes of fulfilling contracts, managing appointments, and\u2014subject to separate consent\u2014contacting customers regarding offers and newsletters. Data processing is conducted in accordance with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Customer data will not be disclosed to third parties without consent. Further details are set forth in the studio\u2019s separate privacy policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kontaktaufnahme durch das Studio: Das Studio kontaktiert seine Kunden f\u00fcr terminbezogene Mitteilungen (z. B. Terminbest\u00e4tigung, Terminerinnerung) sowie f\u00fcr allgemeine Kundeninformationen auf folgenden Wegen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>By phone\u2014using the phone number provided by the customer.<\/li>\n\n\n\n<li>By email\u2014using the email address provided by the customer.<\/li>\n\n\n\n<li>Via WhatsApp Business\u2014provided the customer has provided a WhatsApp-enabled number and has not objected to being contacted through this channel.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The customer may object to being contacted through specific channels at any time in any form (e.g., via message or in person at the studio). This does not affect contact for purely contractual purposes (e.g., last-minute appointment changes).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newsletter &amp; Offers \u2013 optional &amp; can be unsubscribed from at any time:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispatch of newsletters, promotional offers, birthday messages, or other promotional information is provided exclusively on a voluntary basis and only with the customer\u2019s express consent. Consent is not a prerequisite for using our services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The customer may revoke their consent at any time and without providing a reason\u2014by email, phone, WhatsApp, or in person at the studio. Once consent is revoked, no further promotional messages will be sent. Unsubscribing does not affect existing appointment bookings or ongoing contractual relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 12 Promotional Offers &amp; Discounts<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Special offers and promotional prices are valid only during the specified promotional period or while supplies last. Multiple discounts or promotions may be combined only if this is expressly stated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 13 Changes to the Terms and Conditions<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The studio reserves the right to amend these Terms and Conditions at any time, effective for the future. Existing customers will be notified of any material changes (e.g., via a notice posted on the premises, email, or direct exposition at the website).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By using the services after the amended Terms and Conditions have been announced, the new version is deemed to have been accepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When new Terms and Conditions are published, all previous versions become invalid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 14 Final Regulations<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
